The Central DeWitt Community School District and the Board of Directors have been involved in an ongoing lawsuit filed by The DeWitt Observer, a subsidiary of Sycamore Media, regarding a Board meeting that occurred on February 7, 2022. The District and the Board have been working closely with legal counsel in defending against the allegations outlined in the lawsuit. We have previously opted to limit any statements regarding the matter in an effort to allow the court to fully consider the issue.
The court recently entered a ruling in the ongoing lawsuit, finding that, while the Board followed proper procedures to enter a closed session during the Board meeting, the Board discussed matters during the closed session that did not directly relate to the stated basis for the closed session. Consistent with the order from the court, the District is providing The DeWitt Observer with an unredacted copy of the audio recording and minutes of the Board meeting. The Board maintains that the individual Board members acted appropriately leading up to and during the closed session. The Board entered into the closed session with the correct intentions – to evaluate the Superintendent. During the closed session, the conversation flowed into current issues with the intention of providing the Superintendent feedback on how he was handling these issues. As a Board, we recognize that during the course of the closed session, the conversation inadvertently strayed from the intended purpose. While the conversation was relevant and thoughtful, it should have occurred in an open meeting.
The District and the Board respect the decision issued by the court and will proceed in a manner that ensures this does not happen again. The Board will be receiving additional training regarding the legal requirements of Iowa’s open meetings law so we can make better informed decisions moving forward. This training will be open for the public to attend. The Board will also be reviewing processes and procedures for managing closed sessions, consistent with the recommendations from the court. As a Board composed of community members, we remain committed to representing our community and our parents, families, and students as our District strives to provide the best educational experience for the students and families of the Central DeWitt Community School District.
